Alas, we must agree to disagree on this one. I too enjoy a great deal of what I’ve seen from Max Hardcore (Mr. Little). However, he often goes (went) over the line.

This seems to be an extreme example of those profit motivated actions. Jesse Jane was either the most believable actress ever to perform in any film and deserves an Academy Award, or she was in extreme emotional and physical distress. She has publicly stated that she will never work with Max again. A halt should have been called and the production stopped or reorganized within less believable guidelines. Max’s own extreme perversion or his desire for profit, undermined his common sense.

This film distressed me and genuinely upset me. Max went to jail for four years because of this film. Legally it has been judged and Max was convicted. Yet, this shows up on this board and exposes us to the scrutiny of many people that enjoy nothing more.

I would rather have this danger to our fantasies removed and get back to “Fantasy”.

With my genuine respect, but good friends must sometimes agree to disagree!

Just to comment on that point. I've seen his work in the past and all of Max Hardcore's movies made me uncomfortable a little disgusted. I like fantasies, so it takes a lot to get me to admit that. I just finished watching the clip and I have to agree with some of the points you made. She may have been following the script, although it seems unlikely to me, but in any case this typical of his disgusting style.

I think people should judge for themselves, because it's a truly controversial piece. I'm not sure it's my cup-of-tea, but my main concern is for Max's inmates who he is undoubtedly raping mercilessly as we debate this.

HRH has hit it right on the head. The girl, no matter that she is a porn actor, says no,, dont.. stop. Max doesnt stop, what he does in fact do.. is actually rape her. This site isnt about real rape, and that is exactly what this movie is.. a real rape. It doesnt matter that it started out as a porn.. it stopped being porn the second she said no.

Most, if not all of us here have at one time or another claimed that we really respect women. So where is our respect for this this woman, who is a victim? And why celebrate Max, who is a rapist?

Just a couple thoughts on the Max Hardcore controversy and this thread:

First - I've seen the video but admit to skipping through most of it. Not a big Max fan myself. Most of his stuff seems very formula driven and holds little interest after the first minute or two. I know that his scenes get very intense/abusive but nothing compared to some bdsm material that's out there. Further, this looked pretty much like most of his other scenes so the actress must have had some idea what was going to be involved. I've also notice in some of his videos, they use hidden safe "signals" to break a scene or not (e.g. the actress is holding on to her heels). The fact the actress in this case said "I got to stop" may have been part of the scene as opposed to her wanting to stop. I've heard him use that expression "stay in the scene" in other videos to encourage an actress along. I can't judge. Only the actress can say whether or not she felt she was unable to stop. I don't believe she ever made an allegation as to rape or other criminal behavior. I would give good odds that if the federal prosecutors thought they could have nailed Max on a "rape" charge, they would have gone after that with red tooth and claw. Either way, it was not charges of "rape" or dressing an adult woman as a teen (which the Supreme Court has deemed not illegal) which resulted in a conviction.

Max was convicted on "distribution" of obscenity charges. The distribution occured over the internet and by mail. Can't confirm this but I believe it is the only obscenity conviction for a non-child porn case in the last 8 years. What is even more shocking about this case is that Max's company only produced the videos. Another company was responsible for distribution. Prosecutors in Tampa had postal inspectors order the videos through a third party distributors and not "Maxworld". They then went after Max saying he should have known that the distributor would be selling videos into a city that would deem the material as obscene using local community standards.

So let's think about this for a minute: First, Maxworld doesnt sell the videos to people in Tampa but he get's convicted for distribution. Second, the definition used to convict is based on "local community standards" as defined by 12 random jurors. So the justice system assembles 12 public citizens in a room and makes them watch these videos. Then each juror has to voice their opinion as to whether or not they felt it was "obscene"? Can you imagine any scenario there wouldnt be a conviction? (Even in a city like Tampa which has a thriving Adult Industry). And finally it should be mentioned that the videos were not sold for commercial display. They were only meant for people to enjoy them in the privacy of their own homes! So much for the gov't not intruding into our bedrooms.

Some people on the board link a "conviction" against Max to question whether the video should be available or if doing so puts the board at legal risk. They are missing the bigger point. EVERY video link posted on this board would likely be deemed "obscene" using the "community standards" method at least in Tampa and I would imagine quite a few jurisdictions beyond. Also EVERY person who has shared a download link could very well be deemed a "distributor" particularly given the very loose definition as applied to Maxworld. You may find the video in poor taste (I do) and loath Max as a person (I do), but we should all feel a chill at what happened to him. The procedures used were so ill defined and capricious, it could envelop just about anyone who enjoys adult entertainment - kinky or not.

Totally not my thing. This is the first Max vid I ever watched and it just made me uncomfortable. I love rape fantasies but his seem more extreme then most. I just didn't find it sexy in the least.

I'm going to look at the clip but based on the text written up there, it sounds like Max really might have deserved to get what he did up there (and that's saying a lot coming from me). I admittedly did not know much about the case but felt that she might have exaggerated but now, I'm believing that she might have a legitimate case here. "I gotta stop" sounds not part of the script. It does indeed sound like rape.

Okay, enough is enough. This thread should have been moved to a discussion area long ago. The constant bumps are getting on my nerves.

The young “lady” in question came into a porn shoot strung out. Watch the video. Of this, there is no doubt. She immediately got in over her head (no pun intended) and tried to withdraw. For profit or perversion, Max pushed the scene to the max (pun intended).

I agree with some, it’s not rape. Max wasn’t convicted of rape. In my opinion, he was convicted for being arrogantly stupid . He dressed up a drugged out “porn star” to appear to be under aged and then proceeded to tell the world that he was going to “rape her ass”. From a pornography standpoint, I’m more liberal than most. Certainly, I am below the curve as far as any conventional community standards are concerned. But, I consider this production to be obscene and far below my standards of acceptability.

Max is where he should be.

There isn't much left to be said, but I suppose I may be able to clarify a few minor points.

Most bondage or S&M shoots do employ safe words and safe actions. You can't really count on the dialogue such as it is to indicate is the actress does or doesn't want to continue. That said most professionals are very sensitive to even the possability that the actress may have forgotten the safe options and will halt taping to verify that the actress is ok if her acting is too credible.

Personally I disagree with the court ruling for the very same reasons that many of you here already have stated. I do not believe that you can or should legislate morality and that seems to be what they were doing.

On the subject of using the US mail for a carrier. You should note that the sting agents requested to have the DVDs sent to a PO Box. The US Postal Service is the only carrier service legally allowed to deliver to PO Boxes. The distributor erred in accepting a PO Box for a shipping address. The production company should have specified in its contract with the distributor that only alternate carriers would be used.

Our country's puritan roots are showing. Making laws to keep people from being exposed to undesired materials is reasonable (and yet I still receive spam in my snail mail box every week). Preventing other people from acquiring said materials if they desire to seems considerably less reasonable. To suggest that because my neighbor doesn't approve of it I am not allowed to purchase a certain movie(containing no illegal activity) or book is simply unacceptable.
