Yeah, there are ways around things, but would it be worth it for those businesses to directly challenge the US like that. Also there is the fact that if the US deems they are in violation of US law there is the possibility of arrest or extradition should their corporate leaders ever visit the US or a friendly country that has an extradition treaty.

Just guessing on that last point, international law can be tricky. I'm just thinking of the wikileaks guy, look at all the grief he has set himself up for.
